Refusal of Unsafe Work Policy

1. Introduction

My Biggest Little Dream Studio is committed to providing a safe and healthy work environment for all employees. We recognize the importance of empowering employees to identify and address unsafe work conditions. This policy outlines the procedures to be followed when an employee believes that a task or condition is unsafe and chooses to refuse to perform the work.

2. Employee Right to Refuse

2.1. Conditions for Refusal:

  • Employees have the right to refuse work if they believe, on reasonable grounds, that the work task or condition presents a danger to their health or safety, or to the health or safety of another person.

  • Reasonable grounds may include the presence of a hazard, inadequate training, or insufficient personal protective equipment.

2.2. No Reprisals:

  • Employees exercising their right to refuse unsafe work will not face any form of reprisal or discriminatory action.

  • No employee will be disciplined, terminated, or otherwise penalized for refusing to perform work they believe is unsafe.

3. Procedure for Refusing Unsafe Work

3.1. Immediate Supervisor or Manager:

  • When an employee identifies unsafe conditions, they must immediately report their concerns to their immediate supervisor or manager.

  • The employee and supervisor/manager will assess the situation together to determine if it is safe to proceed.

3.2. Involvement of Health and Safety Representative:

  • If the immediate supervisor or manager is unable to resolve the concern to the satisfaction of the employee, the Health and Safety Representative should be involved.

  • The Health and Safety Representative will assess the situation independently and, if necessary, consult with the Joint Health and Safety Committee.

3.3. Involvement of WorkSafeBC:

  • If the concern remains unresolved, the employee, supervisor/manager, or Health and Safety Representative may contact WorkSafeBC to request an inspection and investigation.

  • WorkSafeBC will conduct an impartial assessment to determine if the work task or condition is unsafe.

3.4. Alternative Work Assignments:

  • While the refusal is being investigated, reasonable efforts will be made to assign the employee alternative duties that do not pose a risk to health and safety.

4. Return to Work

4.1. Resolution of Concern:

  • If, after investigation, it is determined that the work is not unsafe, the employee will be expected to return to their regular duties.

4.2. Continuous Improvement:

  • My Biggest Little Dream Studio is committed to continuous improvement in health and safety. The circumstances leading to the refusal will be thoroughly reviewed, and corrective measures will be implemented to prevent similar concerns in the future.

5. Communication

All parties involved in the refusal of unsafe work, including the employee, supervisor/manager, Health and Safety Representative, and WorkSafeBC, will maintain open communication throughout the process.
